Important Updates on Short-Term Rental Regulations in Hampton, Virginia

As a seasoned short-term rental host and owner, I always strive to stay up-to-date with the latest regulations in our area to ensure compliance and provide the best experience for my guests. The City of Hampton has recently adopted new regulations regarding short-term rentals (STRs), including popular platforms like Airbnb and VRBO. These changes, effective September 1, 2024, are designed to preserve the character of our neighborhoods while accommodating the growing demand for short-term lodging. Here’s everything you need to know about these new regulations.

Understanding the New Regulations

Density Limits and STR Zones:
The City of Hampton has introduced a new zoning district overlay that controls the distribution and density of STRs across the city. To prevent an oversaturation of STRs and maintain the character of residential neighborhoods, the city has capped the number of STRs allowed in each zone. Specifically, a maximum of 1% of the residential dwellings within each zone can be used as a short-term rental. This measure ensures that while the demand for short-term rentals is met, neighborhoods retain their residential feel.

  • Searchable Map: To see where these STR zones are and understand the distribution, you can access a searchable map here.
  • PDF Map Version: For those who prefer a static version, you can download the PDF map here.

Proximity and Separation:
Under the new regulations, STRs must be separated by at least 500 feet, with the exception that two STRs can be directly adjacent to each other. This spacing requirement is crucial for reducing potential nuisances and preserving neighborhood peace. However, during the August 14, 2024, City Council Legislative Meeting, an amendment is being considered to reduce this separation requirement to 300 feet. If approved, this change will also take effect on September 1, 2024.

Permitting Process:
The new regulations introduce an administrative permitting process for STRs. To apply, there is a $200 application fee and a $50 inspection fee. All STRs must comply with specific conditions addressing safety and operational concerns. You can find detailed information on the specific regulations here.

Applying for a Short-Term Rental Permit

If you’re interested in starting your own short-term rental or need to comply with the new regulations, here’s how you can apply:

  1. Complete the Use Permit Application: Before September 1, please fill out the Use Permit Application and the Short-Term Rental Supplemental Form.
  2. Submit a Floor Plan: Your application must include a floor plan that shows the general composition of the structure and details such as room dimensions, safety equipment, and evacuation routes. Example floor plans can be found here.
  3. Submit Application: Send all required documents to [email protected]. After September 1, applications will be processed electronically in the order they are received.

For those applying after September 1, there will be an updated electronic submission process available on the city’s website.

STR Zones at Capacity

Some STR zones have already reached their density limit, meaning no further STRs can be approved in these areas. Starting September 1, you can check an updated list of these zones and register your interest in case an STR ceases operations in your desired area. The application process will operate on a first-come, first-served basis, so be sure to stay informed.

Current STR Operations and Compliance

  • Grandfathered STRs: If your STR received an approved Use Permit before the 2024 changes, it may continue to operate legally under the original conditions.
  • Grace-Period STRs: STRs with a business license obtained before December 14, 2022, must comply with the new regulations by December 31, 2024. These will be approved upon submitting the necessary application materials.
  • Illegal Operations: STRs operating without the proper permits must comply with the new regulations to continue operating legally.

Reporting Issues with STRs

If you encounter any issues with a short-term rental in your neighborhood, you can easily find out if the property is legally permitted by checking the STR map. If it is a permitted STR, you can contact the responsible local person listed for that property to resolve issues. For non-emergencies related to STRs that remain unresolved, or for unpermitted STRs, contact the 3-1-1 Citizen Contact Center by calling (757) 727-8311 or emailing [email protected].

Stay Informed and Get Involved

The City of Hampton engaged extensively with the public while developing these regulations, meeting with focus groups and stakeholders to ensure a balanced approach. Relevant documents summarizing this engagement are available, and ongoing public meetings continue to refine these regulations.
