New Septic Regulations for Virginia Real Estate Transactions Start July 1

Heads up for Virginia homebuyers, sellers, and agents: New septic system regulations go into effect statewide on July 1, 2025, and they could impact your next real estate transaction—especially in rural and semi-rural communities like ours.

What’s Changing?

As of July 1, Virginia law will require that all onsite sewage systems (a.k.a. septic systems) undergo a formal inspection by a licensed Onsite Soil Evaluator, Installer, or Operator as part of a property sale. This applies to both conventional and alternative systems.

Previously, septic inspections weren’t mandated by law—though they were strongly recommended during the due diligence period. Now, they’re officially required.

Key Points:

Inspection must be completed before settlement. The buyer or seller may pay for the inspection—it’s negotiable in the contract. The licensed professional must submit a formal report outlining the system’s condition. If repairs are needed, they must be addressed before closing or handled via escrow agreements.

Why It Matters

If you’re selling a home with a septic system, start early. Getting on a certified inspector’s schedule might take time, and any necessary repairs could delay closing if not addressed upfront.

For buyers, this offers greater peace of mind—you’ll know exactly what you’re getting into before signing on the dotted line.

What I’m Telling My Clients

As a local Realtor who’s sold homes across Williamsburg, New Kent, York, and even rural areas west of Richmond, I’ve seen how overlooked septic systems can become a deal-breaking surprise. These new rules may add a step, but they’ll also add clarity and protection for both parties. That’s a good thing.

If you’re planning to buy or sell a home with a septic system, let’s talk strategy. I can walk you through the new requirements and help line up trusted local inspectors.
